Who We Are

Silicon Valley Agents matches buyers and sellers to the best real estate agents in Silicon Valley.  It is a free service for home buyers and sellers and we never accept payment from real estate agents for invitation to our network.  Instead, Silicon Valley Agents makes money from referral fees from real estate agents who help our users buy or sell a home.


Referral Fees

By using this website you understand that a referral fee will be paid as a result of any home bought or sold through our system.  The referral fee is 25% of the gross commission generated in the transaction.


No Warranties

Silicon Valley Agents is exclusively a referral service and all content provided on this Web site is for education purposes only and does not in any manner create a legal contract express or implied between Silicon Valley Agents and you.  Without limiting the foregoing, the information and services published on this Web site may include inaccuracies or typographical errors.  All information and services are provided “as is” without warranty of any kind.  Silicon Valley Agents and/or its suppliers hereby disclaim all warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. In no event, shall Silicon Valley Agents and/or its suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of this Web site or with the delay or inability to use this Web site, or for any information and services obtained through this Web site, or otherwise arising out of the use of the Web site, whether based on contract, tort, strict liability or otherwise, even if Silicon Valley Agents or any of its suppliers has been advised of the possibility of damages.


Liability 

Silicon Valley Agents everyone associated with it shall not be held liable for any actions taken nor omissions to act by the real estate professionals or the home buyers and sellers to whom we match together.  We trust that the matched parties who use our site will follow the law, perform their services and respective parts at the highest level, treat each other with respect, and avoid dispute.  Should any issues arise, we will not become involved to resolve the dispute.  We serve to connect buyers and sellers to real estate professionals only.


Silicon Valley Agents is not responsible for any errors or delays in responding to a request for a real estate professional caused by an incorrect contact information provided by you or other technical problems beyond our reasonable control.


Indemnity
The real estate agents to whom we refer potential clients shall indemnify and hold Silicon Valley Agents and everyone associated with it harmless from and against all claims, liabilities, losses, damages, costs, charges, attorneys' fees, interest and other expenses of every nature and character arising from or relating to any statements made (or omitted) or actions taken (or omitted) by the referred real estate professional in connection with the performance of his or her duties. 


Dispute Resolution

Any controversy, dispute, or claim of whatever nature arising out of, in connection with, or in relation to the referral services we provide, including any claim based on contract, tort or statute, shall be resolved by final and binding arbitration conducted in Santa Clara County, California, and administered by and in accordance with the then existing rules or practice and procedure of the applicable California Rules of Civil Procedure.  Judgment upon any award rendered by the arbitrator may be entered by any State or Federal Court which would otherwise exercise jurisdiction over the dispute.  Any demand to Arbitrate must be made in writing.  


Other Terms

These Terms of Use shall be subject to and construed in accordance with the laws of the State of California, excluding its conflict of laws and principles.  If any part of these Terms of Use are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision, and the remainder of the Agreement shall continue in effect. 


Privacy

Our privacy policy is simple.  We will not disclose your personal information to anyone who is not directly involved in the process of our matching buyers and/or sellers with the real estate agents who will help them find or sell a home.  Period.


Real Estate Agents

Real Estate Agents in our network are required to execute a short agreement prior to their acceptance.  This agreement outlines the terms of participation in our system and the referral fees among other pertinent provisions.
